Application Form Terms & Conditions

1. Introduction

The FinTech Incubator and Accelerator Program (“FIA” or “Program”) is a program designed to support the growth of local and global participating FinTech startups which can be companies or individuals. The Program is presented by Qatar FinTech Hub (“QFTH” or “Hub”) and run by Qatar Development Bank (“QDB”) on its behalf, having an office and its principal place of business at Qatar Development Bank, Grand Hamad Street. Doha, Qatar. PO Box 22789. The Program is designed to attract the best global FinTech startups to Qatar and support their growth by offering them the following support over a 3-month period (“Acceleration Phase”)

  • Mentorship
  • co-working space,
  • regulatory advice and support
  • support with fund raising and
  • support with accessing the local and global market

A group of participants will be selected from the submissions and be given the opportunity to present their solution to a judging panel that may include executives from QDB and as well as other members of the Hub. FIA may perform any of its activities or exercise any of its rights in connection with the program, whether or not described in these terms. In these terms, references to “you” or the “company” shall mean to the person or company wishing to participate in this program.

2. Overview

The initial phase of the program will take place via your/ your company’s online registration and submission of your solution. Registrations and submissions will be accepted from 1st of March 2020 until the 1st of XXX 2020 (“Submission Period”). Based on a number of factors, including criteria described in section 8, 9 and 10 below and information gained from inquiries and discussions with companies, FIA will invite participants to present their solution in-person or virtually as the case may be during fintech showdown, currently anticipated to occur on or around 9th of April 2020 (“Pitch Days”). The Hub will confirm the date of the pitch days in due course. As a result of the pitch days companies will be selected for the acceleration phase (“finalists”). Finalists will be notified of their selection and will be required to (a) confirm within a specified timeframe that they will be able to attend the Pitch Days and (b) agree to additional terms and conditions that will govern the Acceleration Phase (collectively, the “Post-Selection Materials”).

Registering and submitting for the program, and/or presenting your solutions during Pitch Days does not mean that you will be invited or guaranteed the opportunity to participate in the Program.

The Hub reserves the right, in its sole discretion and without prior notice, to adjust the number of finalists, or to adjust any of the dates and/or timeframes stipulated in these terms for purposes of verifying a participant’s compliance with these terms, or as a result of technical problems, or in light of any other circumstances that, in the Hub’s opinion, affect the proper administration of the Program as contemplated in these terms.

You agree that you will not issue any press release or make any public statement or disclosure about the Program without the Hub’s prior written consent, and that failure to comply with this may result in disqualification.

3. Agreement to terms

By registering for the Program, (a) you agree to comply with all applicable laws, these terms, and any other guidelines or instructions provided to you by the Hub in connection with the Program, (b) you represent and warrant that you have the authority to bind yourself and/or your company and its participants to these terms, and (c) you agree that all decisions of the Hub and the Program’s judges (“judges”) are final and binding on you, your company, and its participants.

To the extent that there is any inconsistency between these terms and any program-related materials, including but not limited to social media, website content, and television, print, or online advertising, the terms shall govern.

4. Submission process

You may register for and submit to the Program by following the instructions at https://www.f6s.com/qatarfintechhubacceleratorwave1 and https://www.f6s.com/qatarfintechhubincubator-wave1 All registrations and submissions must be received by 11:59 p.m. (Qatar time) of the last day of the submission period to be considered for the program. The Hub’s systems shall serve as the official clock for purposes of the registration and submission deadline. All registrations and submissions must be in English . It is solely your responsibility to ensure that you have properly registered yourself/ your company and your solution. The Hub will not be responsible for any lost, delayed, misdirected, incomprehensible, incomplete, damaged, garbled or undeliverable registrations or solutions, or any delay or failure to transmit, process, receive or consider registrations.

5. Eligibility – participants

Only Companies will be eligible to benefit from the acceleration phase, therefore, (i) if you participated in the Program as an individual, and if selected, you agree to incorporate a company that meets the criteria down listed. (ii) if you participated in the Program via a company, then your company should meet all of the following criteria, each determined by the Hub in its sole discretion:

  • Your company is incorporated or registered to do business in Qatar or you agree to register your business in Qatar if selected for the acceleration phase;
  • All participants from your company are at least 18 years old at the time of registration (or at least the age of majority in your/their jurisdiction of residence);
  • If selected for the Acceleration Phase, you agree to have at least one person from your leadership team be present in Doha for the entire acceleration phase;
  • Your product or offering belongs to one of the four areas of interest; payments, Islamic finance, SME and RegTech;
  • Is a minimum potentially viable product;
  • Does not contain, depict, imply or refer (explicitly or otherwise) to any content that:
  • Is inappropriate, objectionable, or unsuitable;
  • Disparages or refers negatively to the Hub, the Program, or any other person or entity;
  • Unnecessarily refers to any third party (person or entity); or
  • Violates any law or any third party’s intellectual property, privacy, personality or other rights (“third-party rights”)
  • Does not contain malicious code, create an information security risk or otherwise compromise the integrity of the solution or related software, data or property;
  • Your product or offering does not infringe or violate any third-party rights, and none of the Hub partners will infringe any third-party rights when they copy, display, modify, transmit or otherwise use the solution in connection with the program or in any other way contemplated herein; and
  • Your product or offering is not the subject of any actual or threatened litigation, claim, or dispute

The Hub may request valid proof of eligibility, including with respect to identity, corporate organization, age and other relevant documentation, and may disqualify a participant at any time without notice for any reason, including, without limitation, if the Hub determines (in its sole discretion) that the provided proof is not sufficient or the participant does not otherwise meet the Program’s eligibility criteria, or the participant fails to comply with these terms or attempts in any way to disrupt or undermine the program or to circumvent any of these terms.

6. Judging process

QFTH and the judges will select the finalists and the winner in their sole discretion. Throughout the program, QFTH may contact you regarding your company, your solution, its implementation, or other relevant topics to assist in evaluating your submission and may share with QFTH and the QFTH party’s information received from such inquiries, correspondence, and discussions.

Because QFTH is seeking innovative ideas and solutions, there is no single criterion on which QFTH, and the judges will evaluate your solution. Solutions will be judged on a combination of the following criteria:

  • How unique, innovative, and/or novel is the product offering?
  • How suitable the product or offering is for the Qatar market?
  • How scalable is the product or offering?
  • How strong company founder profile are?
  • How aligned the product or offering is to Qatar’s country priorities?
  • How compelling are the company’s offerings?
  • How positive an impression did the company and its presentation make?
  • Is the company at a stage of technological development that aligns with QFTH’s interests?

Decisions of the Hub and the judges with respect to all aspects of the Program will be final and binding.

7. Cancellation

The Hub has the right to modify, extend, suspend or cancel the Program in its own discretion without further notice. Similarly, if for any reason the Hub cannot run the Program as planned due to any force majeure events, the Hub may cancel, modify, extend or suspend the program in its sole discretion.

8. Intellectual property rights

You will retain any intellectual property rights you have in the solution that you create and present in your submissions. However, by participating in this program, you acknowledge and agree that to the extent permitted by applicable law, any ideas, concepts, data, materials, or information related to your product or the Program that you share are not confidential or proprietary, and the Hub and others (including but not limited to anyone attending the in-person presentations) may use, incorporate or disclose any of them now or in the future in any manner, and you waive any and all related claims that you may have against the parties or anyone participating in or attending this program.

If your presentation or solution includes likenesses of third parties or contains content or elements not owned by you, you must be able to provide signed written legal releases (in a form that is satisfactory to the Hub) that permit you to use and exploit such content and elements in the manner used and exploited and that permits the Hub to use and exploit the content and elements in accordance with these terms.

In addition, you hereby grant to the Hub an unrestricted, royalty-free, perpetual, irrevocable, worldwide, sublicensable, assignable license to reproduce, communicate, modify, display, transmit, publicly perform, make derivative works from, and otherwise use your submission and solution (in whole or in part) without any fee or other form of compensation, and without further notification or permission, for the following purposes:

  • Administering the Program;
  • Displaying some or all of the solutions at the in-person finalist pitch day, and in any and all media now known or hereafter devised, worldwide; and
  • Advertising or promotion in any media, including without limitation to advertise or promote the Program, future challenges, and Hub’s offerings.

You agree that the Hub is not responsible for any unauthorized use of your submission (in whole or in part) by third parties.

9. Publicity

You acknowledge and understand by attending any program-related event in person as a participant, you agree that the hub may photograph, videotape and otherwise record footage of you in relation to your participation in the Program (collectively, “footage”). By registering, you hereby warrant and represent that you have secured the same consent from each participant from your company. Footage, including all copyright and other rights therein and thereto, will be owned by the Hub, and the Hub will have the right but not the obligation to use, edit, copy, publish and exploit such Footage and all elements embodied therein, in whole or in part, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, publicity, promotional, trade and other purposes without further notification, permission, or consideration.

Except where otherwise prohibited by law, you consent to the Hub’s use of your company’s name as well as your name, voice, likeness, biographical information and other indicia of identity in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, publicity, promotional, trade, and other purposes without further notification, permission, or consideration. You also grant to the Hub a revocable, non-exclusive, non-transferable license to use your or your company’s trademarks, service marks, logos, trade dress, trade names and service names to publicize your company and your participation in the program.

By registering for the Program, you are representing and warranting that you have secured the same consent from each participant from your company equivalent to the consents in the preceding paragraph and you agree that you will secure the same written consent from any person who accompanies you or accompanies a participant from your company to any program-related event or other Hub event. You agree that you will provide the Hub with copies of the written consents required by this section 8 upon request by the hub

10. Disclaimers, liability, and indemnification

Subject to paragraph 4 bellow, the hub does not accepet liability for any loss or damage of any solution or for any other loss or damage resulting directly of indirectly from yout participation in the program. The hub materials or support are provided on an "As In" and "As Available" basis with no warrenty. You agree that the hub have not made and are not responsible or liable for any warraty, representation, or guarentee, statutory, express, or implied (Including but not limited to the implied warranties of merchantibility, title, and fitness for a particular purpose), in fact or in law, relative to the program, or any award or benefit. The hub shall not in any circumstances be responsible or liable to yout for:

  • Incorrect or inaccurate transcription or registration or submission information or late, lost, incomplete, misdirected solutions, or registration or solution recieved through impressible or illegitimate channels.
  • Technical feature of any kind, including the malfunctioninhg of any telephone, computer, network, hardware or software The unavailability or inaccecibility of the hubs any service. Unautorized human intervention in any part of the registration, submission or judging process of the program.
  • Electronic or human error which may occur in the administration of the program or the processing of registration or solution submission or in the judging process; or
  • Any injury or damage to persins or property, including your computer, which may caused, directly or indirectlt, in whole or in part, from your participation in the program or from downloading or using any matrial provided by the hub

Nothing in this agreement shall exclude or in any way limit the hub's liability for fraud or death or personal injury caused by itd negligence, or for any other liability to the extent that such liability may not be exclude or limited as a matter of law.

Subject to paragraph 4 above, the hub will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the program, or program benefits or these terms.

Without prejudice to the foregoing and subject always to paragraph 4 above, the hubs maximum aggrigate liability to you howsover arising (Whether for breach of contract, tort, (Including negligence or otherwise) out of or in connectionwith the program or benefits of these term is limited to the direct losses only and shall in no circumstances exceed the sum of one thousand US Dollars (US $1,000).)

You hereby release and agree to indeminify and hold harmless the hub from any and all damages, injuries, claims, causes of action, liabilities, costs and expenses (Including legal fees and expenses), or losses of any kind, known or unknown, absolute or contingent, now or in the future (Including but not limited to personal injury or death) arising from or related to:

  • Any breach or alleged breach by you of any representation, warranty, or obligation contained in these terms.
  • Any misrepresentation you make under these terms or otherwise to the hub.
  • Your participation in the program.
  • Your solution or the use or distribution thereof;or
  • Your Reciept, use or redemption of any award or benefit, or your inability to recieve, use of redeem my award or benefits.
11. Personal information

The Hub may collect personal information from participants for the Hub’s own legitimate interests, including for the purposes of administering and advertising the program. All personal information collected from you will be processed in accordance with the Hub’s privacy policy and any preferences expressed by entrants during the Program entry process. You have the right to access, withdraw, and correct personal information held about you, and to oppose the collection or processing of it. You may request such action by contacting the Hub at fintech@qdb.qa. Your personal information may also be shared with our subcontractors to administer the Program.

Whenever you submit any information to us in order to administer the program, please be aware that the Hub will be processing this data in accordance with the provisions of the Qatar data protection laws. Please note that Qatari law may be different from the laws and requirements about privacy and data use than where you live.

12. Governing law and disputes

The Program, these terms, and any matter arising out of or in connection with them are governed by the laws of Qatar and are subject to the exclusive jurisdiction of the Qatari courts, and you hereby waive and agree not to pursue any actions in any other jurisdiction or venue. You also agree to waive any right to claim ambiguity in these terms, except to the extent expressly prohibited by applicable law.

13. Waiver

Failure by the Hub to enforce any term of these Terms will not constitute a waiver of that or any other provision.

14. Relationship to the Hub

You acknowledge that nothing in these terms will constitute an employment, joint venture, or partnership relationship between you and the Hub. In no way are you to be construed as the agent or to be acting as the agent of the Hub in any respect, and vice versa.

To further its aim of developing the FinTech industry in Qatar, we also aim to partner with institutions and other associations from Qatar and globally to cooperate on initiatives relating to the FinTech industry.

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Performance of contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

9. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

10. International transfers

Some of our external third parties are based outside the State of Qatar so their processing of your personal data will involve a transfer of data outside the State of Qatar.

Whenever we transfer your personal data out of the State of Qatar, we ensure a similar degree of protection is afforded to it by ensuring the following safeguard is implemented.

We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the State of Qatar.

11. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

12. Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances you can ask us to delete your data: see Request erasure below for further information.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

13. Your legal rights

By using this website you are agreeing to these terms.

Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to:

  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data.
